PricingNow – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PricingNow.com and related services, applications, and features (collectively, the “Service”). The Service is operated by S. Lavie Media LTD (“PricingNow,” “we,” us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility & Use of the Service

You may use the Service only if:

• You are able to form a binding contract with PricingNow.

• You comply with these Terms and all applicable laws.

• You provide accurate information when creating an account, including your real name.

• If you are under the legal age of majority, your parent or legal guardian must consent to these Terms and accept full responsibility for your use.

• You are responsible for maintaining the confidentiality of your password and all activity under your account.

2. Nature of the Service

PricingNow is a community-driven Q&A and content platform focused on software pricing research and recommendations. Users may:

• Post questions and answers, vote on content, and interact via comments.

• Submit optional software inquiries or leads. PricingNow partners with SoftwareAdvice for lead generation; inquiries submitted through their widgets go directly to SoftwareAdvice and are not collected or stored by PricingNow.

• PricingNow is an affiliate website earning commissions from vendor referrals, lead submissions, and ads.

3. User Content

“Content” includes text, data, posts, and comments created by users.

• You retain ownership of your Content but grant PricingNow a worldwide, royalty-free license to use, reproduce, modify, and distribute it across partners and search engines.

• AI Disclosure: You acknowledge that some Q&A content is generated or refined using AI tools like Google Gemini and OpenAI ChatGPT.

• You warrant that your Content is lawful, non-defamatory, and does not infringe the rights of others.

4. License to Use the Service

PricingNow grants you a personal, revocable, non-exclusive license to use the Service. You may re-post Content only if:

• You do not modify the Content and include clear attribution with a link back to PricingNow.

• Automated scraping of user data or content is strictly prohibited.

5. User Responsibilities

You agree not to:

• Violate laws, post harmful/misleading content, or spam users.

• Attempt to hack or disrupt the Service.

• Post false software pricing intended to mislead or promote products deceptively.

6. Affiliate & Advertising Disclosure

PricingNow is supported by affiliate partnerships and sponsored listings.

• We may earn commissions when you click links or submit inquiries to partners like SoftwareAdvice.

• Pricing data may not be accurate or real-time; we do not guarantee vendors will honor mentioned prices.

7. Analytics, Cookies & Third-Party Tools

We use tools like Google Analytics and SoftwareAdvice integration widgets.

• These third parties collect data and deploy cookies per their own policies.

• Note: PricingNow does not control cookies deployed by third-party partners like SoftwareAdvice.

8. No Professional Advice

All content, including pricing estimates and recommendations, is for informational purposes only and does not constitute business, legal, financial, or technical advice.

9. Copyright Infringement (DMCA)

If you believe your copyright has been violated, notify our agent at info@pricingnow.com with all required DMCA elements.

10. Third-Party Links

The Service contains links to external sites we do not control or endorse. You assume all risk when using third-party resources.

11. Account Termination

We may suspend or terminate accounts for violations of these Terms, harmful conduct, or legal reasons. You may delete your account at any time.

12. Disclaimers

The Service is provided “AS IS”. We disclaim all warranties regarding merchantability, accuracy of pricing data, and availability.

13. Limitation of Liability

PricingNow and S. Lavie Media LTD shall not be liable for indirect damages, loss of profits, or errors in pricing information. This includes data processed by third-party partners like SoftwareAdvice.

14. Indemnification

You agree to hold PricingNow harmless from claims arising from your use of the Service, your Content, or your violation of these Terms.

15. Privacy

Your use of the Service is subject to our Privacy Policy, which details what data we collect (limited to community interactions) and third-party sharing.

16. Governing Law & Dispute Resolution (Israel)

These Terms are governed by the laws of the State of Israel.

• Informal Resolution: You agree to attempt to resolve disputes via info@pricingnow.com first.

• Jurisdiction: Unresolved disputes must be brought exclusively to the courts of Tel Aviv–Jaffa, Israel.

• No Class Actions: You agree to bring claims only in an individual capacity.

17. Changes to These Terms

We may update these Terms periodically. Material changes will be announced via email or site notices.
